CareIndex Addendum to the AuditPoint Terms of Service

Version 2.0 · Effective October 1, 2026 · Replaces CareIndex Terms of Service v1.0 (April 16, 2026)

CareIndex is a product of AuditPoint. Your use of CareIndex and any CareIndex purchase are governed by the AuditPoint Terms of Service (the “Master Terms”) together with this Addendum. Charges appear on card statements as AUDITPOINT.

This Addendum adds CareIndex-specific terms. It does not change the Master Terms on payment, refunds, limitation of liability, indemnification, or governing law — those sections of the Master Terms apply to CareIndex in full.

A1Relationship to the Master Terms

Capitalized terms not defined here have the meaning given in the Master Terms. Under Section 14 of the Master Terms, this Addendum controls if it conflicts with the Master Terms, but only on the matters this Addendum expressly addresses. Where this Addendum is silent, the Master Terms apply.

This Addendum replaces the CareIndex Terms of Service v1.0 dated April 16, 2026, for all use and purchases on or after the effective date above. The prior version is archived at careindex.ai/terms-v1.html.

A2CareIndex services

This Addendum covers: the careindex.ai website and its public research and regulatory pages; CareIndex reports, including facility, agency, state, and county market intelligence reports; IndexIQ access and credits purchased through CareIndex; any CareIndex newsletter or brief; and custom work through The Research Desk.

A3How purchases are made and accepted

CareIndex products may be purchased through online checkout, by paying an invoice or payment link we send you, or under a written quote for custom work. Completing checkout or paying an invoice or payment link constitutes acceptance of the Master Terms and this Addendum for that purchase. The scope, price, and delivery date of custom work are those confirmed in writing before payment.

A4Reports are point-in-time

A5IndexIQ accounts and credits

A6Healthcare data sources

CareIndex data is drawn from public sources, including the Centers for Medicare & Medicaid Services (CMS) — Care Compare, the Provider Data Catalog, Payroll-Based Journal staffing data, and HCRIS cost reports — as well as the U.S. Census Bureau, HRSA, and state licensing agencies. These sources contain errors, omissions, and reporting lags, and agencies revise their data after publication.

CareIndex is not affiliated with, endorsed by, or acting for CMS or any state agency. CareIndex scores and tiers are produced by our own published methodology. They are not CMS star ratings and are not government findings, designations, or determinations about any provider.

A7Not clinical, legal, regulatory, or investment advice

A8Permitted use — CareIndex specifics

In addition to the uses permitted in Section 8 of the Master Terms, the purchasing organization may:

All other restrictions in Sections 8 and 9 of the Master Terms apply, including the bans on resale, public redistribution, removing attribution, sharing access outside the purchasing organization, and using our content to build a competing product.

A9Provider data disputes

If you are a provider and believe our data about your facility or agency is wrong, contact inquiries@careindex.ai with the specific item. We respond within 10 business days, as set out in Section 11 of the Master Terms. Because our data comes from federal and state sources, most errors must be corrected at the source — for example, through your CMS reporting channels, your Medicare Administrative Contractor for cost reports, or your state licensing agency — and the correction reaches CareIndex at our next refresh. Where appropriate, we may add a note to the affected record in the meantime.

A10Additional terms

Disclaimer of warranties. To the fullest extent permitted by law, CareIndex and all reports, data, scores, and content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.

Suspension and termination. We may suspend or terminate access to CareIndex for violation of the Master Terms or this Addendum, or for non-payment. Sections on intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.

Severability. If any provision of this Addendum is held unenforceable, the remaining provisions remain in effect.
